The following terms and conditions of sale apply to all orders placed with the Driftwood Gifts & Art online shop (Driftwood, us, our) by you, the customer (you, your, user) (in addition to the Terms of Use, which apply to the use of the). By placing an order for goods you are deemed to have accepted these terms and conditions of sale.
Purchasing
To purchase goods from the Driftwood online shop, you select products and add them to the Shopping Cart. Once you have all the products required, you submit your order by completing the Checkout process. Your order is an offer to buy the goods in accordance with these terms and conditions. We will send you an email confirming receipt of your order and your order details. We currently use PayPal as a secure method of taking online payments. PayPal will process your payment on our behalf.
The supply of goods from the online shop is subject to availability. Whilst we always try to inform you if any goods are unavailable before you place and order, we cannot always do so. If this happens you will be informed by email and you will either not be charged or be refunded for any unfulfilled items.
Once we have established that we can supply what you have ordered we will send you a confirmation email. Our confirmation email is our acceptance of your offer to buy the goods at the agreed prices.
All prices stated on the online shop are in Great British Pounds (sterling).
Delivery
We currently deliver in the UK mainland only.
Parcels will be dispatched either through Royal Mail or Courier, dependent on weight. Courier deliveries will require a signature at receipt. The processing, postage and packaging charge is calculated at the Checkout stage and is paid along with your goods at that time.
Cancelling your Order
You have a statutory right to cancel your order by notifying us in writing within 7 working days of delivery.
Your right to cancel does not apply:
to goods you have used and which are therefore not in a saleable condition; or
to all goods or services, if you are acting in the course of business.
To cancel your order and claim a refund, write to us at the "Returns Address" below within 7 working days from delivery. Provide your name and contact details, your order number and a description of the goods being cancelled.
Return any goods you have already received to the same Returns Address in a wrapped, saleable condition, using the address label and returns slip provided on the delivery note. We recommend you use registered or recorded delivery to ensure they reach us safely. If you do not return cancelled goods, we have the right to collect the goods from you and charge you for the full cost of postage and our reasonable on-costs.
If you wish to cancel before delivery, contact us by telephone or email with your name, address and order number. We will try to cancel the order before it is sent, but we may not be able to if your cancellation is too late in the delivery process. If the goods are sent after you cancel, you will need to cancel your order and return the goods as detailed above.
For cancellations, we will refund the purchase price and the postage and package charges that we charged you within 30 days of your cancellation notice. You are responsible for the costs of returning the goods and these costs are not refunded.
Your right to cancel is separate from other statutory rights you may have.
Faulty Goods
If any goods ordered from us are faulty, return them in the packaging they were sent in. Include the address label and returns slip provided on the delivery note as soon as possible to the 'Returns Address' below. If we find that the goods are faulty, and you have returned them within a reasonable period, we will refund the purchase price to you, including the postage and package that we charged and what you incur for returning goods (standard recorded delivery charges). This refund policy does not affect your statutory rights.
We will endeavour to replace faulty goods if you specifically request a replacement in your returns note.

Liability
Driftwood shall not be liable if we or our affiliates are unable to fulfil our obligations due to circumstances that are beyond our reasonable control.
Driftwood shall not be liable for any indirect or consequential losses, or for any business losses (including loss of profits) you may suffer as a result of any breach of these terms and conditions of sale.
We do not limit or exclude our liability for death or personal injury caused by our negligence.
Governing law and jurisdiction
These terms and conditions of sale shall be governed by and enforced in accordance with the laws of England and Wales. Driftwood and you both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales. |
